https://www.shopify.com/legal/privacy?utm_source=social&utm_medium=forum&utm_campaign=guru%2Bask

3.1 Use of Personal Information, Third-Party Privacy Policies & Liability

3.1.1. We do not sell, rent, trade, publish, or otherwise disclose your personal information to third parties in exchange for money. However, we may showcase aspects of our work, which could include information you provide, for business development purposes such as portfolios, case studies, or promotional materials. Any information we retain is used solely to support your engagement with us and to operate our business responsibly, ensuring compliance with applicable laws.

Please note, under certain privacy laws, including the California Consumer Privacy Act (CCPA), the sharing of personal information with third-party service providers—such as for advertising, analytics, or other similar purposes—may be considered a "sale" under those laws, even if we do not exchange your personal information for money.

3.1.2. We may share your personal information with third-party service providers to help enhance the services we offer, including improving user experience, conducting marketing activities, and performing analytics. If you do not wish for your personal information to be shared for these purposes, you have the right to opt-out. As detailed in the "California Privacy Rights" and “SECTION 4 - HOW DO I WITHDRAW MY CONSENT?”  below, you can opt-out of such sharing by following the provided instructions or by contacting us directly at info@blacksandpr.com. However, please note that your information may be transmitted to or stored with third-party service providers who assist us in delivering our services. These third parties may have their own privacy policies, which we do not control and are not responsible for reviewing. We are not responsible for their actions or privacy practices, and in the event that a third party mishandles your information, we disclaim any liability for such actions to the maximum extent permitted by law, as their practices are outside of our control.

3.1.3. Although best efforts are made to mitigate the risks, no correspondence, data transmission, or data storage is truly 100% secure. In the course of providing our services, your personal and business information may be transmitted to or stored by third-party service providers. While we implement reasonable technical and organizational measures to protect your information, to the maximum extent permitted by law, Black Sand PR & Entertainment Inc. shall not be liable for any loss, damage, or consequences arising from unauthorized access, theft, breaches, transmission, or storage of your information by third parties. By using our services, you acknowledge and accept these risks and consent to the handling of your information by such third parties in accordance with this Privacy Policy.

3.1.4. We recommend that you review the privacy policies of these third-party providers to understand how your data may be handled. Please refer to our website Terms of Service regarding liability for data transmission, storage, or handling of your personal and business information.

3.2 Use of Portfolio Work and Service Results

We may, from time to time, showcase aspects of our work for business development purposes, including portfolio displays, case studies, or illustrative examples of services provided. This may include general results, outcomes, or the types of services delivered, such as marketing strategies, photoshoots, content creation, or consulting. Examples of where we may showcase our work include, but are not limited to, this website, promotional brochures, emails, newsletters, and other marketing materials and channels.

We may identify you and highlight generalized impacts of our work, such as improvements in sales, engagement, or brand awareness, without disclosing sensitive or proprietary information (e.g., specific financial figures, sales data, or internal reports), unless it is anonymized. In such cases, specific figures may be published, but you will not be identified.

Each client engagement is unique, and any limitations on what may be referenced or published will be specified in the terms of your individual agreement with us. Except where explicitly restricted in your agreement, we may reference work, results, or services provided without requiring additional approval.

3.3 Third-Party Service Providers (Including Payment Transaction Processors)

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways, banking institutions and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

3.4 Third-Party Websites, Applications & Their Privacy Practices

Once you leave our store’s website or are redirected to a third-party website or application, that third party’s own terms and privacy practices will apply to your use of their site. Our Terms of Service and Privacy Policy continue to govern your interactions with us, including any provisions that remain in effect after you stop using our website or that apply when you engage our services.

While our terms do not govern the operations or rules of third-party websites, any disclaimers, limitations of liability, or other protective provisions in our Terms still apply to your relationship with us in connection with those third parties. We are not responsible for the privacy practices of other sites and encourage you to review their privacy statements.

3.5 Analytics, Advertising, & Other Platforms

You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

To help reach our customers and serve them better, our website may use the Conversions API, which could share data directly from Shopify's servers to Facebook (Meta). This means the data may not be blocked by ad blockers.

We strongly urge you to regularly review the Privacy Policies and Terms of Service of our own website as well as those of the following third parties as it may affect the use of your information and may be subject to change without notice: Facebook (Meta), Google, Shopify, Mailchimp.
Please note, this may not be a complete list of relevant third-parties.
